Any order for a product from the online store of the website www.sudestclim.com/boutique requires prior consultation with these terms and conditions.

Accordingly, the consumer acknowledges that he is fully informed that his agreement regarding the content of these terms and conditions does not require the handwritten signature of this document, as long as the customer wishes to order online the products presented in the context of the website shop.

The consumer has the power to safeguard or publish these terms and conditions, being specified that both the safeguard and the publishing of this document is his sole responsibility. The online store set up by the company Sud Est Climatisation as part of the website mentions the following information:

Article 1: Integrity.

These terms and conditions express the full obligations of the parties. In this sense, the consumer is deemed to accept without reservation all the provisions set out in these terms and conditions. Article 2: Object.

The purpose of these terms and conditions is to define the rights and obligations of the parties in connection with the online sale of goods and services offered by the South East Climate Company to the consumer.

Article 3: Ability to contract.

Article 5: Electronic signature.

The consumer's "double click" under the purchase order is an electronic signature that has the same value between the parties as a handwritten signature.

Article 6: Order confirmation.

Contractual information will be confirmed by e-mail no later than the time of delivery to the address indicated by the consumer within the purchase order.

Despite the irrevocable nature of the order placed by the purchaser, Sud Est Climatisation is definitively committed to it only at the moment it acknowledges receipt.

From the confirmation of order, the contract is definitively concluded and cannot be cancelled for any reason outside legal withdrawal time. South East air conditioning can continue the enforced execution in court. In this case, regardless of the length of the procedure, the equipment sold will be charged according to the rate in effect at the time of actual delivery.

An air conditioner requiring installation must be installed in accord with the rules of the art by a qualified professional. No guarantee remedy can be insured otherwise. The customer benefits from the legal guarantee described in Article L211-1 of the Consumer Code, which covers articles 1641 to 1648 of the civil code.

As a reminder this guarantee is due by the seller under 4 conditions:

- that the defect of the product is hidden, - that it predates the conclusion of the sale contract, - that it is so important that the customer would not have bought it or offered a lower price, - that the action is brought in a short time from the discovery of the defect,

Restoration equipment:

All products in the catering material range are guaranteed 1 Years Pieces.

The spare parts are sent by Sud Est Climatisation directly to the customer.

FRANCE GARANTIA: Restoration equipment (metropolitan)

All our equipment is guaranteed one year defective parts (excluding wear parts, windows, hinges, joints... electrical components...) from the date the goods were received. The cost of labour and travel is the responsibility of the buyer.

The SAV is organized by South East Climatization. In the event of a breakdown in the first year, an exceptional financial contribution to the workforce may be granted after study

The warranty is subject to the following conditions:

- The goods must not have been modified or intervened by persons not mandated by South East Air conditioning.

- The failure should not have been caused directly or indirectly by faulty maintenance, abnormal use of the device or by environmental conditions that do not conform to its proper functioning (electric surge, lack of meter power, etc.).

- Any defective parts will have to be returned to Sud Est Climatisation for expertise before a possible warranty support.

- The defective parts will be shipped in port paid at the expense of South East Climatisation.

- The spare parts will be shipped and invoiced in exchange for reimbursement and a credit will be established in case the factory expertise confirms a manufacturing defect. In the event of a hardware malfunction, South East Climatisation cannot be held responsible for the loss of its contents any more than for any other related damage.

Article 10: Price.

Prices are shown in Euros and all taxes included, they are valid only when the order is received on the date of the send by the consumer. Delivery fees are included in the sale price, delivery is not charged extra. Prices take into account the current T.V.A. applicable on the day of the order and in case of change it will be automatically passed on to the price shown on the online store.

The payment of the entire price must be made at the time of the order. At no time can the sums paid be considered as deposits or instalments.

Article 11: How to pay.

To pay for the order, the consumer has, at his choice, all the payment methods covered within the purchase order. The consumer assures Sud Est Climatisation that he has the necessary permissions to use the payment method chosen by him, when validating the purchase order.

Sud Est Climatisation reserves the right to suspend all order management and delivery in the event of a refusal of authorization to pay by credit card by officially accredited agencies or in case of non-payment. In particular, Sud Est Climatisation reserves the right to refuse to make a delivery or to honour an order from a consumer who has not paid a previous order in full or partially or with whom a payment dispute is being administered.

South East Climatisation has an order verification procedure in place to ensure that no one uses another person's bank details without their knowledge. As part of this audit, the customer will be asked to fax a copy of an ID, a proof of residence and, if necessary, telephone contact information from the customer's bank.

The order will only be validated after receipt and verification by our services of the parts sent.

Payment by cheque:

Payment by cheque can only be made for customers residing in France.

The cheque must be written in order of South East Air conditioning sent to:

South East Climate, Le Pas du Colombier, Nectarines 2, 83600 FREJUS. The customer must specify his name and surname as well as his customer and order number.

This information is given to the customer at the time the order is validated on the 'confirmation' page. The customer can either print this page or write down this information on free paper. In case the customer has not noted this information, they may find it in the order confirmation email sent to them.

In addition, the cheque must be accompanied by a photocopy of the customer's identity card. Any order paid by cheque is processed by the billing department within 24 hours of cashing in and receiving the additional information listed above.

Any cheque that cannot be awarded to an order due to a lack of information will be returned to the person who established it. The cheque will be cashed as soon as it is received by South East Climatisation. Finally, any order by cheque not paid within 15 days is automatically cancelled.

Payment by transfer:

Payment by wire transfer or cheque results in an increase in the time of billing due to the processing and transfer time of the transfer.

Article 12: Product availability.

The order will be executed no later than 3 days from the day after the consumer placed the order. If the product ordered is unavailable, especially due to our suppliers, the consumer will be informed as soon as possible and will have the option to cancel his order. The consumer will then have the choice to request either the refund of the sums paid within 30 days at the latest of their payment, or the exchange of the product.

South East Climatisation works on the basis of the information and stocks made available by manufacturers/distributors. In fact, depending on the case, the devices are available within the limits of the available stocks as indicated on the South East Climatisation website, but this data is not accurate on the day. More information can be provided by phone, email or fax.

However, a product that is available at the time of ordering may no longer be available at the time the order is processed. This is the case for mail orders that give rise to a postal delay, in the exceptional case where a product is no longer available, the customer will be informed by email and will be asked to confirm or cancel his order.

Article 13: Tracking the package.

The tracking of the package depends on the carrier and is its responsibility. South East Climatisation is not responsible for any errors that may be found on carrier websites, nor for any bugs that could hinder the customer's ability to track their package on carrier websites.

Article 14: Delivery problems due to the carrier.

Any anomaly concerning the delivery (damage, product missing from the delivery voucher, damaged parcel, broken products ...) must be indicated on the delivery voucher in the form of "handwritten reservations", accompanied by the customer's signature. At the same time, the consumer will have to confirm this anomaly by sending the carrier within two (2) business days following the delivery date a registered letter with acknowledgement exposing the so-called claims. The consumer will have to send a copy of this email to South East Climatisation.

The parcels are given against the signature to the recipient, otherwise, depending on the case, to the caretaker or concierge of the building. If the package appears to be damaged, the customer must refuse it and make a statement of its condition with the carrier.

As a reminder, the customer also has the option to open his parcel in front of the carrier to verify the compliance of the goods delivered before signing the delivery order of the carrier and to indicate on this voucher, any anomaly concerning the delivery. Any parcel delivered on the side or upside down must be refused by the customer.

Article 15: Delivery time.

The delivery time includes the time it takes to prepare the order, which is added to the transport time. If the product is not available, it must be added to the preparation time and transport time for the product to arrive in the stock. Once the initial announced deadline is exceeded, a new deadline will be communicated to the customer, based on the data known by South East Air conditioning

Article 16: Place of delivery.

Products purchased on the South East Climatisation website are only delivered in France. The carrier delivers 'at the foot of the building', at the customer's expense to mount the aircraft at home. Some drivers ride the package directly to your home, but it is not an obligation. The products are delivered by default to the delivery address indicated by the customer on the purchase order. In case the delivery address is different from the billing address, the customer indicates on the purchase order the two addresses and the parcel is delivered to the specified delivery address.

Article 17 Absence on the day of delivery.

Depending on the case, the carrier may leave a notice of passage in the customer's mailbox, inviting the customer to contact the post office or depot closest to his home or to contact him to make an appointment.

Article 18: Delivery error.

The consumer must make any claim of delivery error and/or non-compliance of the products in kind or in quality with the indications on the purchase order with South East Air conditioning on the day of delivery or no later than the first working day following delivery.

Any claim made beyond this time will be rejected. The formulation of this complaint with South East Climatisation can be made: first by email, fax or mail.

Any claim not made in the rules set out above and within the time limit will not be taken into account and will relieve South East Air conditioning of any responsibility to the consumer. Upon receipt of the complaint, Sud Est Climatisation will assign an exchange number of the product or products concerned and communicate it by email, fax or

by phone to the consumer. The exchange of a product can only take place after the consumer has been given an exchange number according to the approach presented above.

In the event of a delivery error or exchange, any product to be exchanged or refunded must be returned to the South East Climatisation company as a whole and in its original packaging, in Colissimo Recommended. To be accepted, any return will have to be reported beforehand to the Customer Service of South East Climate. The shipping costs are borne by South East Climatisation, except in the event that it turns out that the product taken over does not correspond to the statement of origin made by the consumer in the return voucher.

Article 19: Right of withdrawal.

The consumer (individuals only) has 7 working days to return, at his own expense, the products not suitable for him. This period runs from the day the consumer order is delivered. If this period expires on a Saturday, Sunday or public holiday or holiday, it is extended until the next business day. Any return should be reported beforehand to the Customer Service of South East Air conditioning primarily by email by logging on to our website in the "follow your order" section where, after entering your customer number, you can get your order number. The product must be returned to Colissimo Recommended after receipt of the return voucher. Only the products returned as a whole, in their original packaging complete and intact, and in perfect resale condition, will be taken back. Any product that has been damaged, or whose original packaging has been damaged, will not be refunded or exchanged. This right of withdrawal is exercised without penalty, with the exception of return fees. In the event of the exercise of the right of withdrawal, the consumer has the choice of requesting either the refund of the sums paid or the exchange of the product. In the event of the exercise of the right of withdrawal, the company Sud Est Climatisation will make every effort to reimburse the consumer within 30 days. However, given the technical nature of the products sold, this period may be extended to 45 days, especially when the product needs a technical check (see products to be tested beforehand). The consumer will then be reimbursed by recrediting his bank account (secure transaction) in case of payment by cheque in other cases.

Article 20: Force majeure.

Neither party will have failed in its contractual obligations, as long as their execution will be delayed, hindered or prevented by a fortuitous case or force majeure. considered as a case of force majeure or fortuitous cases, in addition to those usually used by the jurisprudence of French courts and tribunals: the blocking of means of transport or supplies, earthquakes, fires, storms, floods, lightning, stopping telecommunications networks or difficulties specific to telecommunications networks outside customers.
